NOIDA: The National Green Tribunal has expressed dissatisfaction with Noida Authority‘s response regarding illegal residential and commercial constructions.
The tribunal, chaired by Justice Prakash Srivastava on July 28, directed the Authority to submit a fresh affidavit within three weeks along with specific details about individuals, properties, projects, and their locations.
The names of the builders and projects submitted before the NGT by petitioner’s counsel, Akash Vashishtha, include Pristine Greens and Krishna Elite Homes, Bisrakh Jalalpur village, Greater Noida West —being built on agricultural and abadi land. Among other projects named by the counsel are the Trinity High Street in Jalpura, Vihaan Heritage in Bisrakh, Subodh Bhati Market, Aimnabad, Samtel Enclave/Dwarka City on GT Road, Greater Noida, and the Kiwood Decor shopping centre near Lotus Villa, Jalpura.
Similar directives were issued to the Greater Noida Authority, the Noida district magistrate, and the groundwater management council. The tribunal is hearing the matter in the form of the Original Application (OA) 328 of 2024, filed by former municipal corporator Rajendra Tyagi, who sought action against the builder for usurping agricultural land and proceeding with rampant construction without obtaining environmental clearance from the relevant authorities.
“We have also examined the photographs enclosed with the affidavit as an annexure. Most of these photographs are old, from Nov 2022, before the filing of this original application. Thus, we find that respondent No 15-Noida has failed to provide a clear picture of such illegal constructions being done in violation of environmental norms and the action taken against them,” the tribunal noted.
Vashishtha said that the tribunal issued specific directions on two earlier dates, but the authorities have not paid any heed. “Despite the directions passed by this tribunal on Dec 9, 2024, and March 27, 2025, in the vicinity and villages such as Chhipyana, Roja, Roja Jalalpur, Sadullapur, Vaidpura, Saini, Kheri Bhanauta, Sunpura, and Patwadi, large-scale illegal and unauthorised constructions and plottings are being carried out by the respondents,” he said.
Attaching photographs to depict the progress of ongoing alleged illegal construction work, Vashishtha said that they were supposed to be verified by the UP Pollution Control Board, and the authorities were supposed to take action.
Accusing the authorities of being in collusion with real estate developers carrying out illegal construction, the petitioner pointed to larger chaos when the projects would be handed over to the customers and an order for their demolition is issued by the authority.
“The builders and agents are trying to sell off these properties as early as they can, and to show that they are legal, they have also obtained electricity connections and made RCC roads,” Vashishtha said, demanding the formation of a committee under the guidance of the tribunal to prepare a report from the ground.
The petition names 56 villages in Greater Noida and 18 villages in Noida, among several others, where illegal and unauthorised colonies and townships are being raised, in contravention of the provisions of the Air Act and Water Act.
